Your data

The protection of your data and the consistent implementation of the high European and national data protection standards plays a central role in our company. We transmit your data only for internal administrative purposes in order to be able to offer you the best possible service and a wide range of products. Your personal data will only be passed on to third parties who do not belong to our group of companies if we are under a legal obligation to do so, if this is necessary in the context of contract processing and our range of services and if we have a legitimate interest in passing on such data or you have given us your express consent to the transfer of such data. When we use external service providers, we carefully select and commission them in writing. They are bound by our instructions and are periodically controlled by us. The service providers will not pass your data on to third parties. Any transfer of data to third parties for commercial or non-commercial purposes does not take place.

You can visit our website without providing any personal information. We only process your personal data if the processing is required within the definition of Art. 6 (1 b) GDPR for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract. If the processing is necessary within the definition of Art. 6 (1 c) GDPR for compliance with a legal obligation to which we are subject, if you have given your consent within the meaning of Art. 6 (1 a) GDPR to the processing of personal data concerning you for one or more specific purposes or if the processing is necessary within the meaning of Art. 6 (1 f) GDPR to safeguard the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms, which require protection of personal data.

When you visit our website, our web server will by default collect data about each access to the offering, so-called server log files such as the name of the accessed website, date and time of access, the previously visited page or also the identification data of the browser type or operating system used. We use this data only for statistical evaluations for our business purposes, for security and to optimize our offering. This data cannot be associated with specific persons. However, we reserve the right to check this data subsequently if there is a justified suspicion of illegal use based on concrete evidence.

Data security

We protect your data using technical and operational safeguards against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our security measures are regularly reviewed and updated in line with technological progress.

Your rights

You have at all times the right to obtain information free of charge about the personal data stored about you, its origin and recipients and the purpose of the data processing.

You have a right to have your data deleted or blocked in the event that you no longer wish us to store your data, as well as a right to have your personal data corrected if we have stored it incorrectly.

You can revoke your consent to the processing of your data at any time without giving reasons. Finally, you have a right to data transferability.

Protection of minors

Persons under the age of 18 should not transmit any personal data to us without the consent of their parents or legal guardians. We do not request personal data from children and young people. We do not knowingly collect such data and do not pass it on to third parties.

Session cookies

We use cookies with our Internet presence. These are text files or other storage technologies that are stored on your terminal device by the Internet browser you use. Through these cookies, certain information from you, such as your browser or location data or your IP address, is processed to a varying and individual extent.

This processing makes our website more user-friendly, more effective and more secure.

The legal basis for this processing is Art. 6 para. 1 sentence 1 para. 1 lit b DSGVO, insofar as these cookies process data for the initiation or execution of contracts.

If the processing does not serve the purpose of contract initiation or contract processing, our legitimate interest lies in the improvement of the functionality of our Internet presence. The legal basis is then Art. 6 para. 1 sentence 1 para. 1 lit. f DSGVO.

These session cookies are deleted when you close your Internet browser.

Third party cookies

It is possible that our website may also use cookies from partner companies with whom we cooperate for the purpose of analysis or the functionalities of our website.

Details on this, in particular on the purposes and legal basis for processing such third-party cookies, are presented below:

Possibility of elimination

You can prevent or restrict the installation of cookies by adjusting your Internet browser settings. It is also possible to delete already saved cookies at any time. However, the steps and measures required for this depend on the Internet browser you are actually using. We would like to point out that in the case of so-called flash cookies, however, processing cannot be prevented by the browser settings. Instead, you must change the settings of your Flash player. The steps and measures required for this also depend on the Flash Player you are actually using. If you have any questions, please also use the help function or documentation of your Flash Player or contact the manufacturer or user support.

If you prevent or restrict the installation of cookies, however, this may mean that not all functions of our website can be used to their full extent.

Google Analytics

We use Google Analytics in our Internet presence. It is a web analysis service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The Google Analytics service is used to analyze the usage behavior of our website. The legal basis is Art. 6 para. 1 sentence 1 para. 1 lit. f DSGVO. Our legitimate interest lies in the analysis, optimization and economic operation of our Internet presence.

Usage and user-related information is transferred to a Google server in the USA and stored there. However, we use Google Analytics with the so-called anonymization function. With this function Google shortens the IP address already within the EU or EEA.

The data collected in this way is in turn used by Google to provide us with an evaluation of the visit to our website and the usage activities there. This data can also be used to provide other services related to the use of our website and the use of the Internet.

Google itself states that it will not link your IP address to other data. In addition, Google provides you with further information on data protection law at: https://www.google.com/intl/de/policies/privacy/partners.

You can find a so-called deactivation add-on along with further information on this here:

https://tools.google.com/dlpage/gaoptout?hl=de.

We can point out that this add-on can be installed with the most common Internet browsers and offers further control possibilities over the data that Google collects when you visit our website. The add-on informs the JavaScript of Google Analytics that information about visits to our website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analysis services.

Our newsletter

With our newsletter we inform you about us and our offers and events, art fair participations and exhibitions in museums and art institutions. If you register for our newsletter, we will save your e-mail address, first name(s) and last name, as well as any information you chose to provide on a purely voluntary basis, such as postal address, location, area of interest etc.

The data storage is always based on our legitimate interest in the statistical evaluation of the newsletter campaigns for the optimization of marketing and better alignment with the interests of our subscribers within the meaning of Art. 6 Para. 1 S. 1 lit. f DSGVO.

For the dispatch of newsletters, we use the provider Mailchimp, an offer of The Rocket Science Group, LLC with headquarters in the USA. From a legal point of view, the use of mail-chimp is a data processing in a third country. We would like to point out that e-mail addresses and other data collected in the context of the newsletter – including browser and system information, IP address and time of access – are also stored on Mailchimp’s servers. We have entered into a contract with Mailchimp for the distribution of our newsletter via Mailchimp to ensure the protection of your data. This means that Mailchimp will use the information you provide to send and evaluate the newsletter on our behalf. A use for the optimization or improvement of our own offers is not excluded. A contact by this contract partner does not take place. We may trust in the reliability and the IT- and data security of the provider.

We would like to point out that we evaluate your user behavior when sending the newsletter (Mailchimp’s built-in tracking). We expressly point out that your consent also covers this data use/data storage. You can object to this tracking by unsubscribing from our newsletter. You will find further information on this at the end of this section. The information is stored as long as you have subscribed to the newsletter. After you unsubscribe, we store the data purely statistically and anonymously. Such tracking is also not possible if you have deactivated the display of images in your e-mail program by default. In this case the newsletter will not be displayed completely and you may not be able to use all functions. If you display the images manually, the above-mentioned tracking will take place.

The privacy policy of Mailchimp can be found on https://mailchimp.com/legal/privacy/.

The legal basis is Art. 6 para. 1 sentence 1 lit. a DSGVO. You can revoke your consent to the storage of data, the e-mail address and its use for sending the newsletter at any time with effect for the future. To do so, please send a short e-mail to mail [at] galeriemolitor.com. Each newsletter also contains a link to unsubscribe from further information.

Social media and online service providers

We are also present in social networks and online service providers such as Instagram. On the social networks we advertise our presence on our website. A linked name of the respective network is used to link the sites. The use of this linked name prevents that when a website with a social media application is called up, a connection is automatically established to the respective server of the social network to display a name of the respective network itself. Only by clicking on the corresponding name is the user redirected to the service of the respective social network.

After the user is forwarded, information about the user is collected by the respective network. We refer to the above mentioned information. It cannot be excluded that the data collected in this way will be processed in the USA.

These are initially data such as IP address, date, time and the page visited. If the user is logged into his user account of the respective network during this time, the network operator may be able to assign the collected information of the specific visit of the user to the personal account of the user. If the user interacts via a “share” button of the respective network, this information can be stored in the user’s personal user account and published if necessary. If the user wants to prevent the collected information from being directly assigned to his user account, he must log out before clicking on the graphic. In addition, it is possible to configure the respective user account accordingly.

The following social networks are linked to our site:

• Instagram LLC

Contact

If you contact us via contact form, inquiry button or e-mail, the data you provide will be used to process your inquiry. The data is required to process and answer your inquiry. Without this information and its provision, we will not be able to answer your enquiry, or at least not fully.

The legal basis for this processing is Art. 6 para. 1 sentence 1 para. 1 lit. b DSGVO. In the course of the further development of our website, changes to this privacy policy may become necessary. We therefore recommend that you reread this data protection statement from time to time.

For any questions or concerns you may have, please contact our data protection officer Marie-Christine Molitor, mail [at] galeriemolitor.com.
